How we can help
Our NSW Constitution Tool asks you a series of questions about how you would like your association to operate – in simple, plain English – then generates a downloadable, customised constitution that your association can edit or vote to adopt.
Our tool will help you create your constitution that is customised to your association’s needs, compliant with New South Wales law, and set out in plain language.
How our tool works
Associations often choose to write their own rules so their governing document suits the specific needs of their group. If you decide to write your own rules, our tool will help make sure they meet legal requirements.
Free to use
We know how costly legal information can be. That’s why we’ve created this free tool – to help your organisation get started with rules.
We have included links to other resources and to where you can get more free help, as well as clear steps of what to do next.
What is a constitution and why is it important?
Incorporated associations in New South Wales must have a governing document that sets out the rules and procedures for how the group will operate. This document is called the association’s ‘constitution’ or ‘rules’.
Under New South Wales law, certain things must be included in an association’s constitution. The Associations Incorporation Regulation 2022 (NSW) includes a template constitution called the ‘model constitution’ which includes these compulsory items. You can download the model constitution from NSW Fair Trading’s website.
Associations often choose to write their own constitution so their governing document suits the specific needs of their group. If you decide to write your own constitution, our tool can help make sure it meets certain legal requirements.
Justice Connect’s Not-for-profit Law program is a national legal service, offering free and affordable legal supports for not-for-profit organisations and social enterprises.
We’re a charity ourselves, with over 10 years’ experience, so we understand the context in which not-for-profit organisations operate. For some organisations, complying with complex laws can be daunting. For others, it is prohibitively expensive. That’s why we provide timely and appropriate legal support – to help community organisations make sense of the law, stay legally compliant, thrive within complexity, and achieve good governance.
